Legal & General Affordable Homes have made an application to the First Tier Tribunal asking for dispensation from the provisions of Section 20 Consultation (Landlord and Tenant Act 1985).

Section 20 states that in certain circumstances, where there is an agreement for more than 12 months under which leaseholders may pay over £100 per accounting year, the landlord should follow a consultation procedure. However, a landlord can make an application to dispense with the requirements to consult if there are grounds to do so and it is reasonable in the circumstances. For the reasons set out below, we are required to make such an application.
In relation to your scheme, a manager has been appointed to provide housing management services (your Management Provider). At the time the manager was appointed, there were no shared owners on the site and therefore Section 20 Consultation could not be carried out. To ensure the best value for money for the shared owners, we require the flexibility that the services provided by each of the Management Provider may be provided by an alternative Management Provider. We also now require flexibility regarding which entity within our group will enter into the shared ownership leases moving forward. This is the basis of the application.
We have been asked by the Tribunal to provide you access to the application and the supporting documents. These documents set out in more detail why we have made this Application and why we have asked for dispensation from the Section 20 requirements. - Complete the reply form attached to the Directions and send it to the Tribunal.
- Send to the Applicant’s solicitor and the Tribunal a statement in response to the application (with the case reference number noted at the top). If you do respond you also should send with your statement any documents and witness statements upon which you seek to rely on in evidence.
- Please note that if you do reply, your response will be shared with other customers who also respond.
